Legal bases for the processing of personal data
Below we inform you about the legal bases for the processing of personal data:
- If we have obtained your consent to the processing of personal data, Art. 6(1)(a) GDPR is the legal basis.
- If the processing is necessary for the performance of a contract or for taking pre-contractual steps at your request, Art. 6(1)(b) GDPR is the legal basis.
- If the processing is necessary for compliance with a legal obligation to which we are subject (e.g. statutory retention obligations), Art. 6(1)(c) GDPR is the legal basis.
- If the processing is necessary to protect the vital interests of the data subject or of another natural person, Art. 6(1)(d) GDPR is the legal basis.
- If the processing is necessary to safeguard our legitimate interests or those of a third party and your interests or fundamental rights and freedoms do not override them, Art. 6(1)(f) GDPR is the legal basis.
Disclosure of personal data to third parties and processors
As a matter of principle, we do not disclose any data to third parties without your consent. Should this nevertheless be the case, the disclosure takes place on the basis of the legal bases mentioned above, e.g. when data is passed on to online payment providers for the performance of a contract, on the basis of a court order or because of a legal obligation to hand over the data for the purposes of criminal prosecution, averting danger or enforcing intellectual property rights.
We also use processors (external service providers, e.g. for web hosting of our websites and databases) to process your data. If data is disclosed to processors within the framework of a data processing agreement, this is always done in accordance with Art. 28 GDPR. We select our processors carefully, monitor them regularly and have reserved the right to issue instructions regarding the data. In addition, the processors must have implemented appropriate technical and organizational measures and comply with the data protection provisions of the new version of the BDSG and the GDPR
Data transfers to third countries
The adoption of the European General Data Protection Regulation (GDPR) created a uniform basis for data protection in Europe. Your data is therefore mainly processed by companies to which the GDPR applies. Should processing nevertheless take place by third-party services outside the European Union or the European Economic Area, these must meet the special requirements of Art. 44 et seq. GDPR. This means that the processing takes place on the basis of special guarantees, such as the officially recognized determination by the EU Commission of a level of data protection equivalent to that of the EU, or compliance with officially recognized special contractual obligations, the so-called “standard contractual clauses”.
For recipients in the USA who are certified under the EU-U.S. Data Privacy Framework, an adequacy decision of the EU Commission (Art. 45 GDPR) has been in place since 10.07.2023. This applies, among others, to Cloudflare, Google, HubSpot and Stripe. We base other transfers on standard contractual clauses of the EU Commission (Art. 46(2)(c) GDPR).
Erasure of data and storage period
Unless expressly stated in this privacy policy, your personal data will be erased or blocked as soon as you withdraw the consent given for processing or the purpose of storage ceases to apply or the data is no longer required for the purpose, unless its further retention is necessary for evidentiary purposes or statutory retention obligations prevent erasure. These include, for example, retention obligations under commercial law for business letters pursuant to Section 257(1) of the German Commercial Code (HGB) (6 years) and retention obligations under tax law pursuant to Section 147(1) of the German Fiscal Code (AO) for accounting vouchers (8 years) and for books and annual financial statements (10 years). When the prescribed retention period expires, your data will be blocked or erased, unless storage is still necessary for the conclusion or performance of a contract.
Existence of automated decision-making
We do not use automated decision-making or profiling.
Provision of our website via Cloudflare and creation of log files
- Our website is delivered via Cloudflare Pages and the Cloudflare content delivery network (provider: Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA). If you use our website for information purposes only (i.e. without registering and without otherwise transmitting information), Cloudflare processes on our behalf only the data that your browser transmits, in particular IP address, date and time of access, page accessed, referrer URL and information about the browser and operating system.
This data is not stored together with other personal data of yours. - This data serves the purpose of delivering our website to you in a user-friendly, functional and secure manner, in particular protecting against attacks and misuse (e.g. firewall and defense against overload attacks).
- The legal basis for this is our legitimate interest in data processing pursuant to Art. 6(1)(f) GDPR, which also lies in the above purposes.
- A data processing agreement pursuant to Art. 28 GDPR is in place with Cloudflare. Cloudflare is certified under the EU-U.S. Data Privacy Framework; data transfers to the USA take place on the basis of the adequacy decision of the EU Commission (Art. 45 GDPR). Further information can be found in Cloudflare's privacy policy at https://www.cloudflare.com/de-de/privacypolicy/.
Cookies
- We use so-called cookies when you visit our website. Cookies are small text files that your internet browser places and stores on your computer. When you visit our website again, these cookies provide information in order to recognize you automatically. Cookies also include so-called “user IDs”, where user information is stored by means of pseudonymized profiles. We only set cookies that are not technically necessary with your consent, which you give via our cookie banner when you access our website (“opt-in”, Section 25(1) of the German Telecommunications Digital Services Data Protection Act (TDDDG) in conjunction with Art. 6(1)(a) GDPR). You can change or withdraw your selection at any time via the “Cookie settings” link in the footer of our website. We set technically necessary cookies on the basis of Section 25(2) no. 2 TDDDG. The following types of cookies are distinguished:• Necessary, essential cookies: Essential cookies are cookies that are strictly necessary for the operation of the website in order to store certain functions of the website such as logins, shopping cart or user input, e.g. regarding the language of the website. If you choose a language via the language switch, we store your choice in the cookie “k1_lang” (storage period one year) so that we can show you the website in that language on future visits. The legal basis is Section 25(2) no. 2 TDDDG.• Session cookies: Session cookies are required to recognize multiple use of a service by the same user (e.g. to determine your login status when you have logged in). When you visit our site again, these cookies provide information in order to recognize you automatically. The information obtained in this way serves to optimize our services and to give you easier access to our site. When you close the browser or log out, the session cookies are deleted.• Persistent cookies: These cookies remain stored even after the browser is closed. They are used to store the login, for reach measurement and for marketing purposes. They are deleted automatically after a specified period, which may differ depending on the cookie. You can delete the cookies at any time in the security settings of your browser.
• Third-party cookies (in particular from advertisers): According to your wishes, you can configure your browser settings and, for example, refuse the acceptance of third-party cookies or all cookies. However, we would like to point out at this point that you may then not be able to use all functions of this website. Read more about these cookies in the respective privacy policies of the third-party providers.
- Data categories: User data, cookie, user ID (in particular the pages visited, device information, access times and IP addresses).
- Purposes of processing: The information obtained in this way serves the purpose of optimizing our web offerings technically and economically and of giving you easier and secure access to our website.
- Legal bases: If we process your personal data with the help of cookies on the basis of your consent (“opt-in”), Art. 6(1)(a) GDPR is the legal basis. Otherwise, we have a legitimate interest in the effective functionality, improvement and economic operation of the website, so that in that case Art. 6(1)(f) GDPR is the legal basis. Art. 6(1)(b) GDPR is also the legal basis if the cookies are set to initiate a contract, e.g. for orders.
- Storage period/ erasure: The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. In the case of the collection of data for the provision of the website, this is the case when the respective session has ended. Otherwise, cookies are stored on your computer and transmitted by it to our site. You as a user therefore also have full control over the use of cookies. By changing the settings in your internet browser, you can deactivate or restrict the transmission of cookies. Cookies that have already been stored can be deleted at any time. This can also be done automatically. If cookies are deactivated for our website, it may no longer be possible to use all functions of the website to their full extent. Here you will find information on deleting cookies by browser:Chrome: https://support.google.com/chrome/answer/95647Safari: https://support.apple.com/de-at/guide/safari/sfri11471/mac

- Objection and “opt-out”: Regardless of any consent or statutory permission, you can generally prevent cookies from being stored on your hard drive by selecting “do not accept cookies” in your browser settings. However, this may restrict the functionality of our services. You can object to the use of third-party cookies for advertising purposes by means of a so-called “opt-out” via this American website (https://optout.aboutads.info) or this European website (http://www.youronlinechoices.com/de/praferenzmanagement/).
Consent management with CookieYes
- To obtain and manage your consent, we use the consent management tool CookieYes (provider: CookieYes Limited, 3 Warren Yard Warren Park, Wolverton Mill, Milton Keynes, MK12 5NW, United Kingdom). When you visit our website, the cookie banner is loaded from CookieYes servers; in the process, your IP address and technical information about your browser are processed.
- We store your choice in the cookie “cookieyes-consent” in your browser so that we can take it into account on further visits and demonstrate your consent. The storage period is stated in the cookie settings.
- The legal basis is Art. 6(1)(c) GDPR in conjunction with Art. 7(1) GDPR (demonstration of consent) and Section 25(2) no. 2 TDDDG. Transfers to the United Kingdom are subject to the safeguards under Art. 44 et seq. GDPR (see “Data transfers to third countries”).
- You can change or withdraw your consent at any time with effect for the future via the “Cookie settings” link in the footer of our website.
Google Tag Manager
- We use Google Tag Manager (provider: Google Ireland Limited, register no.: 368047, Gordon House, Barrow Street, Dublin 4, Ireland). With Tag Manager, we integrate services such as Google Analytics into our website and control when they are loaded. Tag Manager itself does not set any cookies and does not analyze any data; however, when it is loaded, your IP address is transmitted to Google, including to servers in the USA.
- We load Google Tag Manager only after you have consented to statistics via our cookie banner. The legal basis is your consent under Art. 6(1)(a) GDPR and Section 25(1) TDDDG, which you can withdraw at any time via “Cookie settings”.
- Google LLC is certified under the EU-U.S. Data Privacy Framework; data transfers to the USA take place on the basis of the European Commission's adequacy decision (Art. 45 GDPR). You can find further information in Google's privacy policy at https://policies.google.com/privacy.
Performance of contracts
- We process master data (e.g. company, title/academic degree, names and addresses as well as contact details of users, e-mail), contract data (e.g. services used, names of contact persons) and payment data (e.g. bank details, payment history) for the purpose of fulfilling our contractual obligations (knowing who the contracting party is; establishing, defining the content of and performing the contract; checking the data for plausibility) and service activities (e.g. contact by customer service) pursuant to Art. 6(1)(b) GDPR. The entries marked as mandatory in online forms are required for concluding the contract.
- As a rule, this data is not passed on to third parties unless this is necessary to pursue our claims (e.g. handing over to a lawyer for debt collection) or to perform the contract (e.g. passing the data on to payment providers), or there is a legal obligation to do so pursuant to Art. 6(1)(c) GDPR.
- We may also process the data you provide in order to inform you about other interesting products from our portfolio or to send you e-mails with technical information.
- The data is erased as soon as it is no longer required to achieve the purpose for which it was collected. For master and contract data, this is the case when the data is no longer required to perform the contract and no further claims can be asserted under the contract because they are time-barred (warranty: two years / standard limitation period: three years). Due to commercial and tax law requirements, we are obliged to store your address, payment and order data for up to ten years. However, upon termination of the contract, we restrict processing after three years, i.e. your data is used only to comply with legal obligations. Information in the user account remains until the account is deleted.
Online purchase of day passes and payment via Stripe
- You can buy a day passes for our coworking area online. The “Buy a day pass” button takes you to an order page by HubSpot (provider: HubSpot Ireland Limited, Ireland; parent company HubSpot, Inc., USA). There you enter your e-mail address, first and last name, company, billing address, the desired day and the number of passes. We store this information as well as the purchase and payment in our HubSpot account in HubSpot's European data center (see “Contact via contact form / e-mail / fax / post”).
- Card payment is handled by the payment service provider Stripe (provider: Stripe Payments Europe, Limited, 1 Wilton Park, Wilton Place, Dublin 2, D02 FX04, Ireland). Your card details are transmitted to Stripe in encrypted form; we do not receive the full card number. Stripe also processes, for example, name, e-mail address, amount and time of payment as well as information about your device, browser and IP address in order to execute the payment and prevent fraud. Stripe itself is the controller for its own purposes such as fraud prevention and compliance with legal obligations. Insofar as data is transferred to the USA, Stripe, LLC is certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR). You can find further information at https://stripe.com/de/privacy.
- After payment, we create the invoice in our accounting software Lexware Office (provider: Haufe-Lexware GmbH & Co. KG, Munzinger Straße 9, 79111 Freiburg) and send you the confirmation and invoice by e-mail via Google Workspace (provider: Google Ireland Limited, register no.: 368047, Gordon House, Barrow Street, Dublin 4, Ireland). Invoice creation and dispatch run automatically via the Make service. Data processing agreements pursuant to Art. 28 GDPR are in place with these providers. Insofar as data is processed outside the EU, the safeguards under Art. 44 et seq. GDPR apply (see “Data transfers to third countries”).
- The legal basis is Art. 6(1)(b) GDPR (conclusion and performance of the contract); the information marked as mandatory in the checkout is required for this. For the invoice and its retention, the legal basis is Art. 6(1)(c) GDPR in conjunction with Section 147 of the German Fiscal Code (AO) and Section 257 of the German Commercial Code (HGB); for fraud prevention, it is our legitimate interest in secure payments under Art. 6(1)(f) GDPR.
- We retain invoices and payment records for eight years (Section 147 AO, Section 257 HGB). We erase the other information as soon as it is no longer required for the contract and possible claims (see “Performance of contracts”).
Contact via contact form / e-mail / fax / post
- When you contact us via contact form, fax, post or e-mail, your information is processed for the purpose of handling your contact request.
- Where you have given your consent, the legal basis for processing the data is Art. 6(1)(a) GDPR. The legal basis for processing data transmitted in the course of a contact request or e-mail, letter or fax is Art. 6(1)(f) GDPR. The controller has a legitimate interest in processing and storing the data in order to be able to answer user requests, to preserve evidence for liability reasons and, where applicable, to be able to comply with its statutory retention obligations for business letters. If the contact is aimed at concluding a contract, the additional legal basis for the processing is Art. 6(1)(b) GDPR.
- We may store your information and contact request in our customer relationship management system (“CRM system”) or a comparable system.
- The data is erased as soon as it is no longer required to achieve the purpose for which it was collected. For the personal data from the input screen of the contact form and the data sent by e-mail, this is the case when the respective conversation with you has ended. The conversation has ended when it can be inferred from the circumstances that the matter in question has been conclusively resolved. We store requests from users who have an account or contract with us until two years after termination of the contract. In the case of statutory archiving obligations, erasure takes place after they expire: end of the commercial law (6 years) and tax law (8 years for accounting vouchers, 10 years for books and annual financial statements) retention obligation.
- We operate our contact and inquiry forms as well as our CRM system with HubSpot (provider: HubSpot Ireland Limited, Ireland; parent company HubSpot, Inc., USA). The forms are loaded from HubSpot servers, and your entries are transmitted directly to HubSpot and stored in our HubSpot account, which is maintained in HubSpot's European data center. A data processing agreement pursuant to Art. 28 GDPR is in place with HubSpot. Insofar as data is transferred to HubSpot, Inc. in the USA, HubSpot is certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR). To protect against spam, the forms may use Google reCAPTCHA (see below). You can find further information at https://legal.hubspot.com/de/privacy-policy.
- You may withdraw your consent under Art. 6(1)(a) GDPR to the processing of personal data at any time. If you contact us by e-mail, you can object to the storage of your personal data at any time.
Online appointment booking via HubSpot
- On our product pages and under “Tour”, you can book an appointment yourself for a tour or a phone call with our sales team. For this purpose, we embed a HubSpot appointment calendar (provider: HubSpot Ireland Limited, Ireland; parent company HubSpot, Inc., USA). The calendar is only loaded when you open the appointment booking yourself, for example via “Book a tour” or “Choose a slot”. The following also applies if you access the calendar directly at HubSpot via the “Open calendar in a new tab” link.
- When the calendar is loaded, your IP address, technical information about your browser and the address of the page on which you open the calendar are transmitted to HubSpot. If you have consented to statistics via our cookie banner, we additionally transmit the identifier from HubSpot tracking and the parameters of the address accessed (e.g. campaign information) so that we can match your booking to your visits to our website (see “HubSpot tracking”).
- For the booking, you provide your first and last name, e-mail address and phone number and select the date, time and type of appointment (on site or phone call). We need the phone number for phone appointments and for short-notice questions about your appointment. You can add your company and a message; for appointments regarding conference rooms, the message is a mandatory field. HubSpot stores your information and the appointment in our HubSpot account in HubSpot's European data center, enters the appointment in the calendar of the responsible employee, which we maintain with Google Workspace (provider: Google Ireland Limited, register no.: 368047, Gordon House, Barrow Street, Dublin 4, Ireland), and sends you a confirmation and a reminder by e-mail.
- In the booking form, you can additionally and voluntarily consent to receiving further communications from us. This consent is not required for the booking; you can withdraw it at any time with effect for the future.
- The legal basis for the appointment booking is Art. 6(1)(b) GDPR, as it serves to carry out pre-contractual measures at your request; the information marked as mandatory is required for this. Loading the calendar after your click is strictly necessary to provide the service you have expressly requested (Section 25(2) no. 2 TDDDG). We transmit the tracking identifier and the campaign information only with your consent (Art. 6(1)(a) GDPR and Section 25(1) TDDDG), which you can withdraw at any time via “Cookie settings” in the footer of our website. The legal basis for further communications under item 4 is your consent under Art. 6(1)(a) GDPR.
- Data processing agreements pursuant to Art. 28 GDPR are in place with HubSpot and Google. Insofar as data is transferred to the USA, HubSpot, Inc. and Google LLC are certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR; see “Data transfers to third countries”). You can find further information at https://legal.hubspot.com/de/privacy-policy.
- We erase your information as soon as it is no longer required to process your request; if a contract is concluded, the periods under “Performance of contracts” apply. Appointment booking is voluntary: you can also reach us by phone or via our contact forms.
Contact by phone
- When you contact us by phone, we process your phone number as well as the time and duration of the call in order to handle your request. For phone calls, we use the cloud telephony service Aircall (Service provider: Aircall SAS, 11-15 rue Saint-Georges, 75009 Paris, France). We log calls with your phone number in our CRM system HubSpot (see “Contact via contact form / e-mail / fax / post”) so that we can match your request and call you back. The data is also stored for liability and security reasons in order to be able to prove the call. In the case of unauthorized advertising calls, we block the phone numbers.
- The legal basis for processing the phone number is Art. 6(1)(f) GDPR. If the contact is aimed at concluding a contract, the additional legal basis for the processing is Art. 6(1)(b) GDPR.
- We erase the call data as soon as it is no longer required to handle your request and no statutory retention obligations prevent this. Insofar as Aircall processes data outside the EU, the safeguards under Art. 44 et seq. GDPR apply (see “Data transfers to third countries”). We review blocked phone numbers annually to determine whether blocking is still necessary.
- You can prevent your phone number from being displayed by calling with your number withheld.
